City Way School of Motoring, Terms and Conditions of business commencing 16th February 2023. 

The Use of our website or services is governed by these Terms & Conditions. By using our website or services, you agree to accept on the STRICT understanding that you have read, understood and accepted these terms and conditions below.

Automatic Driving Lessons  

General Terms and Conditions

 1) A suitable car will be provided for driving lessons, which is insured, taxed and has an MOT (if required). The vehicle will be fitted with dual controls for your safety and regularly serviced to the manufacturer’s servicing schedule.

2) Driving License – Due to changes in the way we obtain information about your entitlement to drive, since the abolishment of the counterpart of your driving license on the 8th June 2015, we will now ask you, before your first driving lesson, to provide us with a “check license code” that you will obtain via the DVLA website. Full details will be available explaining what you need to do. This will allow us to view your license information on one occasion within 21 days of you providing the code.

We may during the course of your driving lessons check your license again and ask you to follow the initial process.

You will be required to notify us of any matter that may affect your ability or entitlement to drive. This includes, but is not limited to taking medication that may affect the ability to drive safely; any medical condition that may affect your ability to drive; any lack or loss of a valid or provisional driving license; any revocation of driving entitlement. A list of medical conditions that need to be reported to the DVLA can be found on this website – www.gov.uk/health-conditions-and-driving

3) You must be able to read a vehicle’s registration number from a distance of 20.5 meters (67 feet- approx. 5 car lengths) with glasses if normally worn.

4) We reserve the right to refuse to give tuition if, in our opinion, it is considered that you are unfit to drive due to any reason, including but not limited to: being under the influence of alcohol or drugs; illness; injury; failing to wear glasses or contact lenses where these are required as part of your license entitlement; wearing footwear or other clothing that would make driving hazardous. In these instances, we would charge you for the missed driving lesson in full.

5) We accept no responsibility for any property left in our vehicle.

6) The last 5 minutes of the lesson, (around 10 minutes for an intensive driving lesson) will be spent debriefing you on your progress and recording your performance, as directed by the DVSA (Driver and Vehicle Standards Agency).

7) Smoking is not allowed within the training vehicle, although we can, if requested, take a break and smoke outside the vehicle.

8) We will provide a car for use on your Practical Driving Test, subject to you reaching a suitable standard that is considered to be safe, and all outstanding payments owed have been paid. Test day payments, if they haven’t been paid already, need to be paid in CASH ONLY at the beginning of the lesson, or by bank transfer 48 hours before the test. If payment in full is not made or in our opinion, your driving could be a danger to yourself or the public, and you haven’t followed our advice to delay your driving test, then the offer of the use of our vehicle will be withdrawn.

You would then need to make your own arrangements for a car to take your driving test. (Test Day Payments = Lesson Before Test, Use of the vehicle during the driving test itself and the travel home – Usual time is between 2.5 & 3 hours dependent on the test time and the length of the lesson beforehand. This will be agreed with you prior to the driving test.

9) We cannot be held responsible for postponements of lessons due to illness or mechanical breakdown; Tuition Vehicle being involved in an accident; nor for the driving test being cancelled or postponed by the Driver and Vehicle Standards Agency, for whatever reason. Should our tuition vehicle not be available on your driving test day, then City Way School Motoring will pay for another driving test fee at the same rate that was booked. This would be the full limit of our liability.

If the DVSA cancels your driving test due to the sickness of staff at very short notice, or for any other reason, you will still have to indemnify City Way School of Motoring the cost of the agreed time booked for the driving test.

A claim can be made to the DVSA, details of which will be provided by your instructor.

10) You agree that it is your responsibility to provide all required documentation required when taking your Theory or Practical Driving Test. City Way School of Motoring accepts no responsibility for any of your losses caused by you not providing this documentation.

11) Driving Lesson prices can go up at any stage – we will give you 14 days notice of any increase.

12) Instructors ask successful pupils for a photograph when they have passed their test. By agreeing to this, you are allowing us to use the photograph online as promotional material.

13) We will always do our best to make sure that you comply with all regulations related to your driving, but in the eye of the law the driver is always responsible for their actions (even learner drivers)

Therefore any fines and points that may be given will be issued to the driver of the vehicle. We are legally required to provide the details of the individual that was driving if requested to do so. (Please note in over 13 years of being a driving Instructor no pupil has ever received a fine or penalty points on their driving License.)

14) We are happy to start and finish driving lessons at a different address (within reason), as long as we are aware at the beginning of the driving lesson and that I have the time to get to my next driving lesson on time.

15) My Tuition vehicle is currently fitted with Front and Rear HD Video Cameras. They are not visible from within the vehicle as they are behind the interior mirror and rear window. (You will be briefed on its use and are shown the cameras) The video cameras are used within your driving lessons when appropriate to highlight any areas of driving that may require addressing. We can easily download the video footage within seconds, replay the driving lesson footage and use it as a way of getting you to understand how you could have dealt with a situation differently or reinforce, where good driving practices have been shown. The Cameras will also record, examples of poor driving (3rd Party), which can assist us if we are involved in an accident.

16) These Terms and Conditions can be amended at any time. Please therefore regularly keep yourself updated with our latest Terms and Conditions.

Special Offers

 1) Special offers (unless otherwise stated) are available only to learner drivers (i.e. holders of a UK provisional driving license).

2) Special offers apply only to new City Way School of Motoring Pupils.

3) Offers are limited to one per Pupil and cannot be repeated.

4) The costs, discounts and savings shown on this website are calculated in direct comparison with our current Pay-As-You-Go prices.

5) Special Offers are available at the sole discretion of City Way School of Motoring and may be replaced or withdrawn at any time.

6) We offer existing or previous pupils referral fees. Recommend us to your friends and receive £20.00 payable after their first driving lesson by bank transfer ONLY.

To qualify, please provide us with the details of the person you have referred before their first driving lesson or ask your friend to mention you at the time of booking.

Intensive Driving Courses

All usual terms apply – Plus

 1) A 50% Non-Returnable Booking Fee is payable to confirm your training dates.

2) The remainder of the course cost is payable in full 21 days before the commencement date.

3) Upon commencement of the Intensive Driving Course, no refunds will be entertained.

4) No guarantee can be given that you will reach the level required to be able to take your driving test, although we will make every effort to make this happen.

5) Each course is for the total amount of hours booked. The total hours of the course booked include the time required for taking your practical test and drive home at the end of the course. Additional hours can be booked with your instructor at the standard hourly rate applicable at the time.

6) All pupils must pass the legally required eyesight test (20.5m or 67 ft). This will be conducted by your driving instructor at the beginning of the first lesson. Should you fail the eyesight checks the course would have to be abandoned until you have corrected your eyesight. Any agreed hours booked in with the instructor would be lost.

7) If your instructor feels that you are not ready to take your practical driving test, due to safety reasons, then you will not be allowed to take your driving test in our vehicle. If this is the case, we will change your driving test to another date acceptable to you or cancel your driving test and refund the test fee.

8) Once the course hours have been organised into the driving instructor’s diary, if you then cancel a driving day and it is less than 1 full clear week from the lesson due date, then those lessons will be forfeited and time lost. No refund will be given.

Gift Vouchers

 1) Can be purchased via my website – You will receive a link to print out the voucher at home.

2) Gift Vouchers only become valid, upon proof of purchase via PayPal etc.

3) Gift Vouchers are valid for 6 months from date of issue, and driving lessons must be started by this date or they expire.

4) Gift Vouchers have no cash value.

5) Gift Vouchers are not transferable.

6) Driving Lessons are only available to those that hold a valid Provisional or Full Driving License.

REFUNDS WILL NOT BE PAYABLE FOR GIFT VOUCHERS.

Refunds

If refunds are due – For example, you have paid for a block of driving lessons, you will receive a refund based on –

1) The hours of driving tuition that you have taken, plus any driving lessons that you have cancelled, without the required notice given. The hours will be charged at our standard hourly rate applicable at that time.

2) The Refunds will be made within 3 working days by bank transfer ONLY, subject to your payment having cleared my account. when providing your bank details, please make sure they are correct as it can be difficult getting the money back from the banks, which will result in a delay or losing your money.

3) City Way School of Motoring reserves the right to deduct a £15.00 administration charge for refunds.

4) All prices, discounts and Special Offers are available at the sole discretion of City Way School of Motoring. Prices are subject to change and any discounts or Special Offers may be replaced or withdrawn at any time. The prices, discounts and Special Offers displayed on the Company Website (Lesson Prices Page) are current and any previous prices, discounts or Special Offers should be disregarded. Any changes to our standard prices or discounts will be updated on the Company Website. (Lesson Prices Page)

5) Payments can be made in by bank transfer  (Please note that we NO LONGER ACCEPT CHEQUES)

Cancellations and Punctuality

 1) A minimum of 48 hours notice must be given to cancel a driving lesson. Non-attendance, failing to give the appropriate notice for whatever reason or not being in a fit condition to drive through drink or drugs will result in being asked to pay for the missed driving lesson in full.

2) All matters relating to the timing, location and duration of individual lessons shall be subject to agreement between the Instructor and the Pupil.

3) In the event that the Instructor is unable to attend a specific appointment, or in the event of mechanical breakdown or other cause, the Instructor reserves the right to rearrange the lesson to a time convenient to both parties. If this happens to be your test day, then City Way School of Motoring will pay for another driving test fee at the same rate that was booked. This would be the full limit of our liability.

4) The Instructor will endeavour to give the Pupil forty-eight hours notice when cancelling any lesson (including weekends and Bank Holidays) due to unforeseen circumstances. The Instructor reserves the right to postpone lessons if they feel that the weather or road conditions are unsuitable or dangerous for a particular pupil based on their experience. City Way School of Motoring cannot be held responsible for any costs incurred as a result of them having to postpone any driving lessons, for whatever reason. In the event that it is considered safe to drive and you want to cancel, then the full cost of the lesson would be charged.

5) The Pupil accepts that it is in their own interests to be punctual for their lesson appointments. Where the Pupil fails to arrive punctually for a lesson, the Instructor would normally make efforts to contact the Pupil and then wait for a maximum of fifteen minutes before the lesson would be abandoned and the lesson fee forfeited or become due for payment. A reciprocal waiting time may become necessary if the Instructor is delayed due to unforeseen circumstances. Any lesson time lost as a result of Instructor delay would be made up by the Instructor either at the end of the normal lesson time if possible or at a later date. The Instructor will endeavour to contact the Pupil to alert them of any delay to his arrival at the agreed meeting point. Any Lesson time lost due to the pupil arriving late will be lost.

Complaints

 If at any time during your lessons, you are not happy about any issue, please feel free to talk this through with your driving instructor, so we can iron out any concerns that you may have.

If the complaint cannot be resolved by talking it through, then please write to me, with full details of the complaint. I will acknowledge the complaint within 5 days of receipt and respond in writing within 21 days.

If you are still not happy with my response, you then have the right to write to the registrar at the DVSA, but this can only happen when our complaints process has been followed. The address to write to will be provided in the written response to you.

By taking Driving Lessons with City Way School of Motoring it is accepted that you have read and agree to these terms and conditions.
